Home health, hospice, home care and HME have become complex businesses with significant challenges. Providers may be uncertain about how they should “triage” legal issues so that they are using their resources as effectively as possible.
There are three (3) major issues that deserve providers’ attention:
- Compliant marketing activities
- Relationships with referring physicians and
- Post-payment audits.
With regard to marketing activities, enforcers regard violations as “low hanging fruit.” Providers need to focus on what they can give to referral sources and what requirements must be met.
Enforcement activities focused on relationships with referring physicians, especially Medical Directors, continue to plague providers.
What are two (2) keys to compliant relationships with referring physicians?
Post-payment reviews cost providers millions of dollars each year and sometimes their entire businesses. What’s the first thing that providers must do when subject to any post-payment review? How can providers communicate effectively with reviewers about why the services they provided meet all applicable requirements?
The emphasis during this presentation will be on clear, practical solutions to address three (3) key legal issues for all providers of services in patients’ homes.

Elizabeth E. Hogue, Esq.
Elizabeth E. Hogue is an attorney in private practice with extensive experience in health care. Prior to becoming an attorney, she was employed as a personnel manager by a Blue Cross-Blue Shield Plan. She studied at the University of Maryland School of Law, concentrating in health law. She gained considerable clinical experience, course work and employment experience in this area. She graduated cum laude.
Following her admission to the Bar, she developed an active practice in health law. She represents clients all over the country. Her clients are professional associations, physicians, managed care providers, ACOs and institutional health care providers, including hospitals, long-term care facilities, home health agencies, durable medical equipment companies, private duty agencies and hospices. She has also represented a number of individual providers and case managers concerning health-related issues.
Ms. Hogue has given approximately 1,100 presentations on health-related topics. She has authored more than 700 articles that are regularly included in trade association publications and other journals. Her books include Nursing Case Law Reporter, Informed Consent, Legal Liability, Medicare/Medicaid Fraud and Abuse, Contracting with Managed Care Providers, Ethics Manual, Termination of Services to Patients: Use of Policies and Procedures to Avoid Liability for Abandonment, Case Management: Legal Issues, How to Develop a Fraud and Abuse Compliance Plan, How to Form Alliances Without Violating the Law, Wound Care: Legal Issues, and How Marketers Can Get Referrals without Breaking the Law.
Ms. Hogue is a Fellow of the American Health Lawyers Association.

For example: if your agency has paid for 1 participating registration but 3 people from your agency would like to attend (and receive CE credit), your agency will need to pay a separate registration fee for all 3 participants. In addition, if your agency has sent in 1 registration but 3 people from your agency register through the Zoom link, your agency will be invoiced the registration fee for the additional 2 registrations. The handouts will be emailed to you to the email address you provide.
Continuing Education: This educational activity is eligible for 1.0 nurse contact hour. The Association for Home and Hospice Care of North Carolina is approved as a provider of nursing continuing professional development by the North Carolina Nurses Association, an accredited approver by the American Nurses Credentialing Center’s Commission on Accreditation.
Cancellation and Substitution Policy: Fees will be refunded, or invoices will be adjusted, only if written notice of cancellation is received by AHHC one week prior to the event. In the event of cancellation, AHHC will retain, or charge, 50% of the initial registration fee, per registrant, to cover administrative overhead. Once written cancellation is received, an AHHC staff member will review for approval. If your cancellation is approved, we will email back a signed and dated copy of the cancellation that your agency should retain on file in case of questions.
